4. User Obligations and Prohibited Activities
As a condition of your access to and use of the Website, you agree to use the Website only for lawful purposes and in a manner consistent with all applicable federal, state, and local laws and regulations. You agree that you will not:
4.1 General Prohibited Conduct
- Use the Website in any way that violates any applicable federal, state, local, or international law or regulation, including laws governing food safety, consumer protection, electronic commerce, and data privacy;
- Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Website, or which, as determined by us, may harm Anthony's Coal Fired Pizza or users of the Website or expose them to liability;

- Collect or harvest any personally identifiable information from the Website without authorization;
- Use the Website to send unsolicited communications (spam);

4.2 Prohibited Ordering Conduct

- Attempting to obtain food or services without payment, or through deceptive means;
- Abusing promotional codes, coupons, or discount offers in violation of their stated terms;

We reserve the right, at our sole discretion, to investigate and take appropriate legal action against anyone who, in our opinion, violates this provision, including without limitation reporting such conduct to law enforcement authorities and terminating the user's access to the Website.
5. Ordering, Pricing, and Payment Terms
5.1 Order Placement
When you place an order through our Website, you are making an offer to purchase food and/or beverages in accordance with these Terms. We reserve the right to accept or reject any order for any reason, including but not limited to product unavailability, errors in pricing or product descriptions, or concerns regarding fraud or misuse.
Upon placing an order, you will receive an order confirmation via email or on-screen notification. This confirmation constitutes acknowledgment of receipt of your order, not acceptance. Your order is accepted when we begin preparing it or when payment is processed, whichever occurs first.
5.2 Pricing
All prices listed on the Website are in United States Dollars (USD) and are subject to change without notice. Prices may vary by location. Applicable sales taxes, delivery fees, service fees, and any applicable surcharges will be disclosed prior to the completion of your order and will be added to your total order amount. You are responsible for all applicable taxes associated with your order.
In the event that a menu item is listed at an incorrect price due to a typographical error or system error, we reserve the right to cancel any orders placed at the incorrect price, and we will notify you as soon as reasonably practicable. We are not obligated to provide any item at an incorrect price.
5.3 Payment Methods
We accept payment by major credit cards, debit cards, and any other payment methods indicated on the Website at the time of checkout. By providing your payment information, you represent and warrant that you are authorized to use the designated payment method and that you authorize us to charge your payment method for the total amount of your order, including applicable taxes and fees.
Payment processing is handled by third-party payment processors. We do not store complete credit card information on our servers. Your payment information is subject to the privacy policy and terms of service of the applicable payment processor.
5.4 Cancellations and Refunds
Once an order has been submitted and accepted, cancellations may not be possible as food preparation may have already begun. If you need to cancel or modify an order, please contact us immediately at [email protected]. Refund eligibility will be determined on a case-by-case basis. We are committed to customer satisfaction and will make commercially reasonable efforts to resolve any concerns related to food quality, order accuracy, or service issues.
6. Food Allergen and Dietary Information
Anthony's Coal Fired Pizza takes food safety and customer health seriously. We make reasonable efforts to provide accurate allergen and ingredient information for our menu items. However, our food is prepared in kitchen environments where cross-contact with common allergens — including but not limited to gluten, dairy, nuts, eggs, shellfish, and soy — may occur. We cannot guarantee that any menu item is completely free from allergens.
If you have a food allergy, sensitivity, or dietary restriction, we strongly encourage you to contact us directly before placing an order to discuss your needs. By ordering from us, you acknowledge and accept the inherent risk of allergen cross-contact. Anthony's Coal Fired Pizza shall not be liable for any adverse reactions resulting from allergen exposure where reasonable care and disclosure have been provided.
7. Intellectual Property Rights
The Website and its entire contents, features, and functionality — including but not limited to all text, graphics, logos, photographs, images, audio clips, digital downloads, data compilations, button icons, software, and the compilation thereof — are owned by Anthony's Coal Fired Pizza, its licensors, or other providers of such material, and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
The Anthony's Coal Fired Pizza name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Anthony's Coal Fired Pizza or its affiliates or licensors. You must not use such marks without the prior written permission of Anthony's Coal Fired Pizza. All other names, logos, product and service names, designs, and slogans on this Website are the trademarks of their respective owners.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Website for personal, non-commercial purposes only. This license does not include the right to:
- Modify, copy, reproduce, republish, upload, post, transmit, or distribute any content from the Website without our express prior written consent;
- Create derivative works based on any content available on the Website;
- Use any content for commercial purposes or for any public display;
- Reverse engineer, decompile, or disassemble any software or technology underlying the Website;
- Remove any copyright, trademark, or other proprietary rights notices from the Website or any content obtained from the Website.
Any unauthorized use terminates the permission or license granted by Anthony's Coal Fired Pizza. All rights not expressly granted herein are reserved.
8. Third-Party Links and Services
The Website may contain links to third-party websites, applications, or services, including third-party online ordering platforms, delivery services, and social media platforms, that are not owned or controlled by Anthony's Coal Fired Pizza. We have no control over and assume no responsibility for the content, privacy policies, terms of service, or practices of any third-party websites or services.
If you use any third-party online ordering or delivery platform to order from Anthony's Coal Fired Pizza, your use of such platforms is subject to those platforms' own terms of service and privacy policies, and Anthony's Coal Fired Pizza disclaims all liability in connection with your use of those platforms. We strongly advise you to read the terms and conditions and privacy policy of every website you visit.
The inclusion of any link on our Website does not imply our endorsement of the linked site or service. Use of any such linked website is at your own risk.
9. Disclaimer of Warranties
THE WEBSITE AND ALL CONTENT, SERVICES, PRODUCTS, AND OTHER MATERIALS AVAILABLE THROUGH THE WEBSITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
ANTHONY'S COAL FIRED PIZZA DOES NOT WARRANT THAT:
- THE WEBSITE WILL BE AVAILABLE, UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE;
- THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE WEBSITE WILL BE ACCURATE OR RELIABLE;
- THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE WEBSITE WILL MEET YOUR EXPECTATIONS;
- ANY ERRORS IN THE WEBSITE WILL BE CORRECTED;
- THE WEBSITE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.
Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you. To the extent that applicable law does not allow the exclusion of such warranties, the scope and duration of any warranty shall be the minimum permitted under applicable law.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ANTHONY'S COAL FIRED PIZZA, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, SERVICE PROVIDERS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING OUT OF OR IN CONNECTION WITH:
- YOUR USE OF OR INABILITY TO USE THE WEBSITE;
- ANY PRODUCTS, SERVICES, OR CONTENT OBTAINED THROUGH THE WEBSITE;
- ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA;
- STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON OR RELATED TO THE WEBSITE;
- ANY OTHER MATTER RELATING TO THE WEBSITE OR THESE TERMS.
IN NO EVENT SHALL THE AGGREGATE LIABILITY OF ANTHONY'S COAL FIRED PIZZA TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE WEBSITE EXCEED THE GREATER OF (A) THE TOTAL AMOUNT PAID BY YOU TO ANTHONY'S COAL FIRED PIZZA IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).
The limitations of liability set forth above are fundamental elements of the basis of the bargain between Anthony's Coal Fired Pizza and you. The Website and the services offered hereunder would not be provided without such limitations. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. In such jurisdictions, our liability shall be limited to the maximum extent permitted by applicable law.
11. Indemnification
You agree to defend, indemnify, and hold harmless Anthony's Coal Fired Pizza, its affiliates, licensors, service providers, employees, agents, officers, directors, and successors from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:
- Your violation of these Terms of Service;
- Your use of the Website, including, but not limited to, your use of any information obtained from the Website;
- Your violation of any applicable federal, state, local, or international law or regulation;
- Your violation of any third party's rights, including but not limited to intellectual property rights, privacy rights, or contractual rights;
- Any content or information you submit, post, or transmit through the Website;
- Any misrepresentation made by you in connection with your use of the Website or any order placed through the Website.
We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of these claims. You agree not to settle any matter without the prior written consent of Anthony's Coal Fired Pizza. We will use reasonable efforts to notify you of any such claim, action, or proceeding upon becoming aware of it.
12. Governing Law and Jurisdiction
These Terms of Service and any dispute or claim arising out of or related to them, their subject matter, or their formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the United States of America and the laws of the state in which the applicable Anthony's Coal Fired Pizza location operates, without giving effect to any choice or conflict of law provision or rule.
For matters arising under federal law, including the Federal Trade Commission Act (15 U.S.C. § 45 et seq.), applicable Federal Communications Commission regulations, and other applicable federal consumer protection statutes, the laws and regulations of the United States shall apply. For California-based users, additional protections may apply under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), California Business and Professions Code, and other applicable California state law.
Any legal suit, action, or proceeding arising out of or related to these Terms of Service or the Website shall be instituted exclusively in the federal courts of the United States or the state courts, in each case located within the United States in the jurisdiction where the relevant Anthony's Coal Fired Pizza business entity is registered and operates, and you waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
13. Dispute Resolution
13.1 Informal Resolution
Before initiating any formal dispute resolution process, you agree to contact Anthony's Coal Fired Pizza at [email protected] and provide a written description of your dispute, the specific relief sought, and your contact information. We will attempt in good faith to resolve the dispute informally within thirty (30) days of receiving your notice. Either party may pursue formal dispute resolution if the dispute is not resolved within this thirty (30) day period.
13.2 Binding Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
Except as otherwise provided herein, if a dispute is not resolved through informal negotiation, you and Anthony's Coal Fired Pizza agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Website, or any products or services purchased through the Website, through binding individual arbitration, rather than in court, in accordance with the rules of the American Arbitration Association ("AAA") Consumer Arbitration Rules, which are available at www.adr.org.
The arbitration shall be conducted by a single neutral arbitrator, and shall take place in the county or state in which you reside or at another mutually agreed location. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction.
13.3 Class Action Waiver
YOU AND ANTHONY'S COAL FIRED PIZZA EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS SHALL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. IF FOR ANY REASON A CLAIM PROCEEDS IN COURT RATHER THAN IN ARBITRATION, YOU AND ANTHONY'S COAL FIRED PIZZA EACH WAIVE ANY RIGHT TO A JURY TRIAL.
13.4 Exceptions to Arbitration
Notwithstanding the foregoing, either party may bring claims in small claims court if the claims qualify, and either party may seek emergency injunctive relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.
14. Term and Termination
These Terms of Service shall remain in full force and effect for as long as you access or use the Website. We may, at our sole discretion, immediately terminate or suspend your access to all or any part of the Website, without prior notice or liability, for any reason, including without limitation if you breach any provision of these Terms.
Upon termination of your account or access:
- Your right to access and use the Website will immediately cease;
- Any outstanding orders already in processing may be fulfilled or cancelled at our discretion;
- Any accrued loyalty points or rewards balances may be forfeited in cases of termination for cause;
- All provisions of these Terms which by their nature should survive termination — including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability — shall survive termination.
You may terminate your account at any time by contacting us at [email protected] and requesting account deletion. Termination of your account does not relieve you of any obligations or liabilities that arose prior to such termination.
15. Changes to These Terms
We reserve the right, in our sole discretion, to modify, update, or replace these Terms of Service at any time. When we make changes to these Terms, we will update the "Last Updated" date at the top of this page. In cases of material changes, we may also provide additional notice, such as a prominent notice on our Website or by sending an email to the address associated with your account.
Your continued use of the Website following the posting of revised Terms of Service means that you accept and agree to the changes. You are expected to check this page regularly so you are aware of any changes, as they are binding on you. If you do not agree to the revised Terms, you must discontinue your use of the Website.
We will not make retroactive changes to these Terms that materially and adversely affect your vested rights without providing prior notice and an opportunity to opt out where required by applicable law.
16. Severability
If any provision of these Terms of Service is held by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be so modified, it shall be eliminated from these Terms, and the remaining provisions of these Terms shall continue in full force and effect to the maximum extent permitted by law.
The invalidity or unenforceability of any particular provision in any jurisdiction shall not affect the validity or enforceability of any other provision, nor shall the invalidity or unenforceability of a provision in one jurisdiction affect its validity or enforceability in any other jurisdiction.
17. Entire Agreement and Waiver
These Terms of Service, together with our Privacy Policy and any other legal notices or agreements published by us on the Website, shall constitute the entire agreement between you and Anthony's Coal Fired Pizza concerning your use of the Website and supersede all prior and contemporaneous agreements, representations, warranties, and understandings with respect to the Website, the content and services provided by or through the Website, and the subject matter of these Terms.
No waiver by Anthony's Coal Fired Pizza of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure of Anthony's Coal Fired Pizza to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
18. Force Majeure
Anthony's Coal Fired Pizza shall not be liable for any failure or delay in performance of its obligations under these Terms to the extent that such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic or public health emergency, war, terrorism, riots, civil unrest, government action, labor disputes, supply chain disruptions, power or internet outages, or any other event or circumstance that is beyond our reasonable control ("Force Majeure Event"). In the event of a Force Majeure Event, we will make reasonable efforts to resume performance as soon as practicable.
19. Electronic Communications
By using the Website or communicating with us electronically (such as via email or through the Website), you consent to receive communications from us electronically. We may communicate with you by email or by posting notices on the Website. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communication be in writing, to the extent permitted by applicable law, including the Electronic Signatures in Global and National Commerce Act (E-SIGN Act), 15 U.S.C. § 7001 et seq., and applicable state laws.
